Amateur Radio DUT Engagement Terms

Terms and conditions governing amateur radio Device Under Test (DUT) engagements with Microwave Analytics.

These Terms and Conditions (the “Terms”) govern amateur radio laboratory engagement services provided by Thurston Laboratories, LLC, operating as Microwave Analytics (“Microwave Analytics,” “we,” “us,” or “our”), to the submitting operator or club (“you” or “your”). By checking the acceptance box on the amateur radio DUT submission form, submitting equipment for testing, or otherwise proceeding with an engagement, you agree to these Terms.

1. Amateur Track Only

The amateur radio program is separate from Microwave Analytics’ commercial, defense, and research engagements. Ham rates and simplified reporting apply only to amateur and personal station equipment submitted through the amateur DUT form. This track is not a substitute for commercial project intake, accredited certification, regulatory approval, or defense/industrial characterization. Work that belongs on the commercial track may be redirected or requoted.

2. Nature of Services

Measurements are performed with laboratory-grade instrumentation and disciplined procedures. Reporting for amateur engagements is simplified and focuses on key quantifiable results rather than commercial-depth documentation. Services do not constitute accredited certification, FCC type acceptance, or design consulting. Optional Bronze, Silver, and Gold recognition, where offered, reflects Microwave Analytics’ published performance criteria for amateur equipment and is not a regulatory certification.

3. Scope and Scheduling

Amateur tests are generally standardized. Microwave Analytics may confirm configuration, frequency range, and deliverables before accepting a DUT. We may decline unsafe, incomplete, or out-of-scope submissions. Turnaround estimates are approximate and not guarantees.

4. Shipping

Published ham prices exclude DUT shipping unless Microwave Analytics expressly arranges otherwise in writing. You are responsible for packing, inbound and outbound shipping costs, insurance you choose to purchase, and accurate labeling. Risk of loss or damage while in carrier custody remains with you, except to the extent caused by Microwave Analytics’ gross negligence after the DUT is received into our custody.

5. DUT Condition

You must disclose known defects, modifications, power limits, and safe operating conditions. You warrant that the equipment may be tested as described without unreasonable risk of injury or damage to laboratory equipment. Microwave Analytics may refuse or stop testing of any DUT that appears unsafe or misrepresented.

6. Results, Certification Marks, and Public Display

Test results and any recognition level are based on measurements under stated conditions. For non-Alliance amateur clients, reports are delivered only after payment is received (see Fees and Payment). Public leaderboards, callsign lookup, and similar displays include results only when you (and Microwave Analytics) have opted in to public presentation. You may withdraw future public display by request; historical public posts already made may not be fully retractable. Misrepresentation of results or recognition is prohibited.

7. Ham Lab Alliance Benefits

Discounts, complimentary tests, and member badges apply only while an applicable Ham Lab Alliance membership is active and in good standing. Alliance membership is optional and is governed by the Ham Lab Alliance Membership Terms. Non-members may submit equipment at standard ham rates. Active Alliance members receive invoices and reports once testing is completed and are not required to pay before receiving reports (see Fees and Payment).

8. Fees and Payment

Fees are as published or quoted for the selected amateur test. Invoices are issued once work is complete. For non-Alliance amateur clients, payment is due on receipt, and reports are sent only once payment is received. For clients with an active Ham Lab Alliance membership in good standing, invoices and reports are sent once testing is completed; Alliance members are not required to pay before receiving reports. Complimentary Alliance tests remain subject to membership quotas and the Alliance Membership Terms.

9. Disclaimer of Warranties

Services and results are provided “as is.” Measurements reflect performance under the stated test conditions and methods. Microwave Analytics does not warrant field performance, regulatory compliance, merchantability, or fitness for a particular purpose. Amateur recognition levels are not guarantees of on-air superiority in all environments.

10. Limitation of Liability

To the maximum extent permitted by law, Microwave Analytics’ total liability arising out of or related to an amateur DUT engagement shall not exceed the fees actually paid for that engagement. We are not liable for indirect, incidental, special, consequential, or punitive damages. We will exercise reasonable care while your equipment is in our custody; except for gross negligence or willful misconduct, we are not liable for damage due to preexisting defects, prototype or modified hardware fragility, or failure during testing within disclosed limits. Maintain insurance for high-value equipment as you see fit.

11. Intellectual Property

You retain ownership of your equipment and personal information you submit. Microwave Analytics retains ownership of methods, fixtures, templates, and know-how. Subject to payment, you may use delivered results for personal and amateur-radio purposes consistent with these Terms and any public-opt-in choices you make.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada. Exclusive venue for disputes shall be the state or federal courts located in Elko County, Nevada.

13. Changes and Contact
